When the whole ITAR thing started up I was selling stuff on Ebay a lot. I had been selling of maintenance manuals for WC half tons. Then, they suddenly became a national security risk as they were for "Military Vehicles." Really? I appealed but as you said, you could never get a real person to talk to. I noticed some sellers who were using the same words could still sell as is. Sometimes I think it has more to do if you bow down or how big you are. Just like with the random words in listing to get hits. Some can do it, some can't.
