Public domain issue

Placing an image where is it accessible is not the same as placing it in the public domain. Allowing an individual to download an image does not confer the right to use that image commercially.

Also all creative works are explicitly covered by copyright and do not need to be declared as such. The use of the copyright symbol or trademake symbol is no longer required to assure protection.
