I believe Ebay has a dispute resolution capability now that claims to be very successfull. You may want to try it first. Buyers and sellers don't always see eye to eye. My last purchase exceeded my expectations 10-fold which sort of made up for some of the smaller crappy "deals" throughout the past 4 years.
