I strongly recommend leaving the filter in place. Just replace the hose(s) and gasket.

Some oil always bypasses this kind of filter because of the way it is plumbed. At very low oil pressure, such as at hot idle, all of the oil bypasses it. However, at higher engine speeds during normal driving, a significant percentage of the oil should be passing through the filter. I think the relief valve is set to open at abut 46 psi, give or take a little. If the pressure relief valve is not opening at normal driving speeds (say, over 1,750 RPM), then you might want to consider a new oil pump and check your bearing clearances. Synthetic oil will help keep the pressure up.
