I had kind of the same thing a couple of months ago and this was your advice to me relating to deposits:

"The deposit is earnest money relaying intent to buy. I will not be willing to take anyone's INTENT to the bank.
There are too many flakes out there. On a real estate deal the bank will never give a loan on earnest money when there are sales lined up like dominoes.One deal falls out and it all changes. it is called contingency."

That said, if you stated in your auction that the buyer has a specified amount of time after the end of the auction to pick up the item and/ or pay for it in full and the person has exceeded that amount of time, then the deposit is forfeited. Otherwise, whats the point of the deposit right?

I have a IHC truck that's been sitting here for 3 months that's been paid for and I cant get a hold of the guy to come get it. It's the lesser truck of a pair of trucks I sold the fellow. I need it out of here.
