In Washington it is legal to leave the wiring as it came from the factory. If there was only 1 tail light from the factory then it is legal even though new vehicles require 2. So you can legally drive with a single tail and brake light. You will get pulled over but you will have to educate the officer that you are legal. I am not saying it is safe but is legal. Not sure what other states require.
