I found a can of the real deal in an abandoned railroad building a while back. Was saving it for something good, but the bottom of the can rusted through and most of it leaked out onto the floor. At least that part of the floor won't rot now. There's nothing fancy about creosote. It's just the liquid fraction of what you get when you heat coal in a retort. A guy in coal country could probably make his own with a 55 gallon drum and some plumbing from the scrap pile.

As for the Califonia rules, it's pretty well summed up by the warning they put on bullets, "Warning: Contains LEAD, a product known to the State of California to cause CANCER or REPRODUCTIVE DAMAGE" We can laugh at California but the trouble is their rules usually end up spreading to the whole country because manufacturers don't want to make different products just for the California market. Hence we can't get anything but those stupid over-priced non-vented gas cans that spill gas all over the place but meet CARB requirements.
