They are indeed encrypted so a scanner can't be used. There are encryption modules on both ends of the transmission.

Police supervisors often have the ability to turn encryption off or on (in the event of a large problem that they want the public to know about). But for general communications in many jurisdictions the police, fire and rescue communications are encrypted.

You can Google "encrypted police communications" for lots of information on the subject.
