I think the point is this: you are indeed gambling and if the tires were the only issue that would be fine, but the bigger issue is that WE are out there on the roads too. Putting others at risk of death or injury to save a few bucks is not being a good citizen. I'm certain that your insurance company would have a hard time defending you from any claim once they found out that the trailer was not up to the task. Better safe than sorry.
