I've been told that the fine for using off-road diesel on the highway is $500 + $50 per gallon of fuel tank CAPACITY ($3000 for a 50-gallon tank). On the other hand, unless you're driving a big rig, the chance of having your fuel inspected is essentially zero. Do you feel lucky? Off road diesel doesn't pay highway tax, but it does pay sales tax, which is a percentage of the price rather than a fixed amount of cents per gallon.
