I somewhat similar situation happened to my son when he was rear ended by another driver. THe other driver's insurance was Allstate. They would not pay us anything, even though their guy was to blame, because he claimed he was "cut off" by another driver and had to swerve into my son. Never mind that there were no witnesses to verify his claim that could be found. Our insurance company, state farm, said that (unfortunately for us) the law allowed "this".
