I'd suggest to you all to take a 'prepayment' at time of auction, papers will go with the truck upon payment in full. Be sure and call it a 'payment' or 'prepayment', that is binding on both parties. Deposits only prevent the sellor from backing out but are not obligations on the buyer. You might also consider a 'liquidated damages clause', which explains that the cost of re-selling it will come out of the buyers money.
