Jimbo, I think it really depends on your local laws. You might call your Secretary of State's office and see if the name is being used by anyone. If not I don't think anyone can say anything about you using it. It's possible that the name is copyrighted but unlikely. In Idaho you have to file with the Secretary of State to protect a business name. You might want to just go ahead and register the name as a DBA. It costs $25.00 here. I drove a 1947 Dodge pickup around with the original business logo. The business had been gone for thirty years.
