The issue of how wide the right of way actually is has not been resolved in court!
(I have requested maps showing the right of way from the county)We were approx. 20-30 feet away from the center line of the original road..I brought this up to the investigators, however they refused to aknowlege that a right of way existed besides the actual road itself! And, the decision to leave what was left of the road was made with the intentions of the route that would cause the minimal damage...what we were faced with had we kept on the 'road' was a diagonal 3-4 foot high ledge that dropped directly into the Jarbidge River that had assumed the path of the road during the washout. So I decided less damage to the land would result from the route we took! In hindsight, I now believe we should have plowed right into the river and we would absolutely been on the road!! I am thinking I may take this route this next trip!! Then they can't cite me for 'leaving the road'!!
