Basically, the citation issued is the equivelent to a moving traffic violation.
The bail is set at $150.00, I accepted the citation whithout admitting guilt, I have the option of either paying the bail and having this minor infraction on my record, or I can plead 'not guilty' on the citation, then get my day in court to present my side of the issue. As you may or may not know, when you are interviewed by a law enforcement official, be it federal, state, county, or city, if you are not somewhat co-operative, they can indeed order you to appear or have a warrant issued for you to appear. This particular matter was not of a significant
issue as far as I was concerned, to end up having a warrant issued. The violations stated may be questionable, but I retain all rights to defend myself. Plus, I nor Dan were ever'under arrest' so the miranda rights were not necessary. We have nothing to hide, thus we both were co-operative with these officers. Thus is also why only one of a possible 4 citations were issued. It was the
disposition of our interviews and the officer's good judgement that it is the way it is. Besides, I don't mind being a 'scape goat' in this particular matter!
